Performing Nonlegal Services? Mind Your Ethical Duties
This program will provide an overview of the Rules of Professional Conduct (and other ethical constraints) that might be applicable to those activities commonly engaged in by real property practitioners that may go beyond or fall outside the practice of law. Through the use of hypotheticals, the program will explore the implications for practitioners who, for example, might act as real estate brokers or agents, property managers, or land use consultants, or provide title insurance or escrow services, or serve as expert witnesses in real estate-related disputes.
