Copyright termination and recapture under 17 U.S.C. Sections 203 and 304 is a complex process filled with traps for the unwary. And while allowing artists to recapture their rights is valuable, does recapture effectively address the inequality between artists and the distributors of their works that exists in copyright law? Copyright termination/recapture is at issue in films  (“Top Gun Maverick”, “Friday the 13th”, “Predator“, Marvel characters), and musical works, including 2 Live Crew, and class actions against major record labels. Join two prominent law professors in this field to discuss these complicated issues: Marc H. Greenberg, author of Copyright Termination and Recapture Laws: Good Intentions Gone Awry (ABA Publishing, 2016), and Kevin J. Greene, who is widely recognized for his pioneering work on African-American music and inequality in copyright law, including his unique perspective on copyright termination, as discussed in his recent article The Future is Now: Copyright Terminations and the Looming Threat to the Old School Hip-Hop Song Book (Journal of the Copyright Law Society, 2021).
