Our panel of bankruptcy experts (Yi Sun Kim with G&B Law, LLP, Joseph Chora with the Law Offices of Joseph Chora, and Theodore A. Cohen with Sheppard Mullin) will discuss the intersection between employment law and bankruptcy vis-à-vis employment litigation. They will answer the most common issues facing employment litigators: What happens if you’ve been litigating a case and the defendant or the plaintiff files for bankruptcy? Are there different strategies if a plaintiff files for a Chapter 7 vs. Chapter 11 bankruptcy? How does a plaintiff employee's earlier bankruptcy filing affect her later employment discrimination case? What happens when the defendant employer files for bankruptcy but has EPL insurance? How can you structure a settlement to avoid or minimize potential bankruptcy claw-backs?
