Black people have long been at the heart of American culture, innovation, and industry - contributing profoundly to music, technology, fashion, and countless other fields. Despite this legacy of creativity and ingenuity, the protections afforded by intellectual property (IP) law have not been equitably accessible or applied to Black creators. This article explores how intellectual property law has historically failed Black creators, and describes how the historical injustices and structural inequities continue to shape the relationship between Black creators and the intellectual property laws purporting to protect them.
