Don’t forget about the $50,000 penalty! Wait what? That’s a thing? Yes! This penalty went into effect 1/1/2023, but is still poorly understood by most workers’ compensation professionals. Whether you are an applicant’s attorney, defense attorney, or Judge, this issue is lurking in all claims coming within Labor Code sections 3212 to 3213.2. (i.e., all of the public safety/fire presumption cases.) This penalty applies when a claim has been “unreasonably rejected.” What does that mean?
