A Practical Guide to Completing Transfer Impact Assessments (TIAs)
Intellectual Property Law Section; Technology, Internet, and Privacy Interest Group
To comply with the new EU standard contractual clauses (SCCs) and Schrems II ruling, both data importers and data exporters must complete a "transfer impact assessment" (TIA) – i.e. an assessment of the recipient country's laws and whether or not they protect the imported data to an essentially equivalent standard to EU law (in particular taking account of local surveillance laws and potential for government access to data). Data transfer compliance in light of these new requirements is currently the single biggest, and most challenging, aspect of EU data protection law at present. In this webinar we will discuss what is required to complete a TIA and provide practical tips on how to approach this task, factoring in both strategic considerations and the recent EDPB Recommendations.
