After the 9th Circuit’s decision in In Re Grand Jury, there is now a three-way split in circuit courts regarding when a dual-purpose communication, a communication between a lawyer and client that has both legal and nonlegal purposes, is covered by the attorney-client privilege. While this case involves a tax lawyer, estate planners also have so much sensitive information regarding
their clients and typically clients do not want that information disclosed. Learn how to better safe guard a client’s file from discovery particularly in light of this 9th Circuit opinion.
