California offers organizations and individuals a meaningful role in the development of appellate precedent through requests for publication and depublication of appellate opinions.

In the last fiscal year, only 8% of all written opinions of our six appellate districts were published (and therefore citable in California Courts) – with district publication rates ranging from 3% to 12%.

This webinar will review the formal policies of the Judicial Council rules governing publication, the unwritten variables, the procedures for seeking publication or depublication and strategies for success. Attendees will receive a link to a Dropbox with the program slides, the Judicial Council rules governing publication and depublication, sample publication and depublication letters and other materials.

Leslie Ellen Shear is one of four lawyers dual-certified by the State Bar of CA Board of Legal Specialization as specialists in family law and appellate law. For many years she has co-chaired the very active Association of Family Law Specialists amicus committee, which has a strong success record for grant of publication and depublication requests. Her associate (and daughter), Julia C. Shear Kushner, will interview Leslie about all aspects of publication and depublication. Julia is a member of CLA’s Committee on Appellate Courts and the Treasurer of LACBA’s Appellate Courts Section.
