SB 54: Compliance, Litigation and Community Relations
SB 54 (California Values Act), effective January 1, 2018, makes California a “sanctuary state” by prohibiting local and state law enforcement agencies from assisting federal immigration authorities (i.e., U.S. Immigration and Customs Enforcement) to enforce Federal immigration laws. Compliance with SB 54 can be publicly monitored under the Transparent Review of Unjust Transfers and Holds (TRUTH) Act, which requires local law enforcement to release statistics on local cooperation with ICE. Cooperation with ICE is highly charged and politically sensitive, and civil and immigration rights groups are utilizing the media, local politics, and the courts to confront suspected violations of SB 54. In July 2019, a legal and civil rights organization filed an administrative complaint against a Bay Area city after it allegedly violated SB 54 by holding for ICE transfer a man after allegedly questioning him about his immigration status during a traffic stop. A civil suit followed in March 2020. Violating SB 54 implicates Fourth Amendment, California Constitutional and tort law, as well as federal statutory and immigration laws and procedures. SB 54 creates a new arena of law, politics, public relations, liability, and risk.
