The WA My Health My Data Act – Implications for Businesses and Individuals
The recently enacted Washington My Health My Data Act (MHMDA) may be the most consequential privacy legislation since the original California Consumer Privacy Act (CCPA) was passed in 2018.
While positioned as protecting the privacy of health data that falls outside the scope of the U.S. Health Insurance Portability and Accountability Act (HIPAA), this legislation includes substantive obligations that in some ways goes well beyond what HIPAA requires. And its broad scope and expansive definitions will result in a sweeping impact on organizations well beyond Washington state — including those that think they are do not collect or process “health data.”
This webinar will provide a high-level overview of the Act and more detailed discussions of the stringent and prescriptive rules around notice, consent, data subject rights and geofencing. We will also discuss the broad applicability of the Act, the risk of lawsuits resulting from its private right of action, the confusion around effective dates, and other issues raised by this groundbreaking legislation.
