Deciphering California’s Complex Environmental Reporting and Disclosure Laws, and Agency Oversight Triggers: California has a complex array of environmental reporting and disclosure laws. But there is a great deal of ambiguity regarding obligations to disclose environmental investigation results that identify "minor" contamination from historic activities. Likewise, determining whether it is necessary, or a strategic benefit, to enlist regulatory oversight is often a key aspect of transactions involving contaminated properties. This panel will provide an overview of the most applicable laws and policies, discuss the nuances of reporting and disclosure obligations, and pros/cons of enlisting regulatory oversight in different deal contexts.
