This interactive discussion is for both criminal and civil practitioners and will include: the constitutional and legislative underpinnings concerning the use of peremptory challenges; the historical background to the A.B. 3070 reform legislation; the analytic framework for A.B. 3070 objections; the differences between the A.B. 3070 and Batson/Wheeler analytical frameworks; and the implications for future application to civil cases beginning 2026. Attendees will learn to apply Civil Code of Procedure section 231.7 in hypothetical scenarios, considering various circumstances for determining whether the statute’s substantial likelihood standard is met and whether presumptively invalid reasons have been rebutted.
