Attorney’s fees issues can drive the resolution of a dispute. Fee issues can provide a mediator with leverage, can assist in or torpedo the resolution of a dispute, and can surprise attorneys and clients, even becoming a source of attorney malpractice. This webinar will review issues every mediator, arbitrator and attorney should know, including the most common bases for contractual, statutory, and common law attorney’s fee entitlement. This webinar will also review attorney’s fees issues that are specific to mediation, such as mediation as a precondition to attorney’s fee recovery, and recovery of mediator fees as costs, best practices for presenting fee issues in arbitration, arbitration and Section 998 settlement offers, exposure to additional fees resulting from county bar attorney’s fee arbitration, and rules for fee recovery in private judicial arbitration services.
