There has been a steady increase in trust and estate litigation of civil procedural practices, including all forms of discovery. The mere mention of discovery can evoke fear and trembling in the most seasoned counsel. Nevertheless, effective discovery practice can hasten dispute resolution, increasing the likelihood of good (and sometimes even fair!) results.
The presenters will provide an overview of the various forms of discovery, their respective procedural frameworks, how they may come into play at different stages of litigation, and party obligations on both sides. The presenters will review recent trends in interpretation and enforcement of the Discovery Act with attention to their application and considerations specific to trust and estate litigation.
