    This training will cover resentencing procedures under California Penal Code section 1172.1, including recent changes to the law. In 2018, former Governor Jerry Brown created a special unit within the California Department of Corrections and Rehabilitation to identify people in prison who had rehabilitated themselves so much that they would be “an asset to their community” if released. Since then, around 2,000 people have been referred under this process. District Attorneys’ Offices throughout California have similarly recommended people in prison for resentencing. During this one hour presentation, learn about this rapidly-developing area of law, obtain practice tips, and hear about inspiring success stories.

    Milena Blake

    Milena Blake is a staff attorney at the Thee Strikes Project at Stanford Law School.  There, she represents inmates serving unnecessarily long sentences in state and federal prison, primarily through resentencing under Penal Code 1172.1 and habeas corpus. She has overturned more than 70 life sentences during her career. The Project remains actively involved in clients’ lives once they are released from custody, helping to provide services and programs that assist clients in the process of returning home and reentering their communities. Prior to joining the project, Milena served as the Policy Director at Californians for Safety and Justice and as Committee Counsel to the California Assembly Committee on Public Safety. There, she worked on pieces of legislation related to sentencing reform as well as improving access to substance use disorder treatment, prison conditions, and access to victim services. Milena also worked as a Public Defender in Solano County, where she specialized in juvenile clients, and was one of the co-authors of Proposition 47.
