After clients decide to effectuate gifts in trust for their children or others, the next question is whether that trust should be established as a grantor trust or anon-grantor trust. The historical calculus on which option is preferable is changing, in light of the introduction of new state taxes, the sunsetting of the tax law changes enacted in the 2017 Tax Cuts and Jobs Act and other potential tax law changes, and shifts in interest rates, market conditions, and attitudes among the Next GEN. This presentation will review the changing landscape on whether a grantor trust or non-grantor trust is the best fit.
