Workplace investigations often entail an assessment of whether a complainant's identity caused them to be targeted or treated differently in the workplace. These identities are often broken down into distinct categories (e.g., gender, race, sexual identity) and are analyzed separate and apart from one another. However, investigators are increasingly faced with the question of how to make these findings when some or all of these identities cannot be considered independently when assessing workplace dynamics. Such is the unique challenge that intersectionality poses to the investigator. In this presentation, the presenters will discuss what intersectionality is and how it can impact investigations. The panel will use hypothetical scenarios and examples from their practice to discuss the unique ways that intersectionality can impact our interviews, our findings, and our client relationships.
