United States litigation and government investigations involving international data are on the rise. The global scope of economic activity and the incorporation of multinational operations are no longer limited to large corporations. With the increase in remote work and the adoption of a broader international workforce, US companies of all sizes are integrating international employees into their business strategies and operations. This expansion has led to a surge in cross-border and multi-language data transfers for US-based litigations and investigations. Companies are leveraging a wide range of new international technologies and applications to boost productivity while expanding their global footprint. With this globalization, US-based companies and lawyers must navigate an ever-changing global market when collecting, reviewing, and producing international custodians’ data for US matters. This session will address how to tackle the challenges of US eDiscovery during the collection, review, and data transfer of internationally located data for US matters.
Discussion points will include: • Complying with non-U.S. data privacy laws and regulations. • Navigating foreign technology during the data collection process. • Resolving cultural issues and misalignment with US matter goals that may arise during cross-border eDiscovery.
