The panel will discuss the conflicting factors considered by plaintiff and defense counsel in making the decision to cooperate in a workplace investigation.  They will discuss their respective POVs where a claimant is represented by counsel and the employer wants to conduct an investigation. E.g., the investigator will speak on why an interview with claimant is desired; claimant's counsel will speak on why he/she is not inclined to cooperate with the investigation, and the employer attorney will discuss why the employer is not willing to agree to provide any portion of the investigation file to such counsel as a condition to such cooperation. In the end, several suggestions will be made on how to address each of their needs and goals.
