    When a family with a loved one who has a disability comes to an estate planning attorney, the engagement too often ends with a third-party special needs trust that preserves eligibility for public benefits and little else. A complete special needs plan requires far more. It requires anticipating who will advocate for the beneficiary after the parents are gone, how the beneficiary will be protected from exploitation, how caregivers will be compensated and overseen, how supported decision-making will be honored, how the letter of intent will guide future caregivers and trustees, how the special needs plan will coordinate with the broader estate plan, and how remainder and tax considerations unique to the third-party context will be addressed. This session equips estate planning attorneys to see what is missing from the standard engagement and to deliver the comprehensive planning these families actually need.
