ABA Formal Opinion 518 has sparked significant discussion within the mediation community about the ethical boundaries of mediator conduct, particularly when mediators offer evaluations, convey negotiation positions between caucus rooms, or use common negotiation techniques to move parties toward settlement. While the opinion is advisory, it may influence state disciplinary bodies and court mediation programs.

This panel brings together leading mediator voices to examine Opinion 518 and its implications for mediation practice. Panelists will discuss where the opinion clarifies mediator ethics, where it may create new uncertainties, and how mediators can balance candor, neutrality, and effective negotiation strategy in light of the opinion’s guidance.
