The procedures for the taking of evidence followed in international arbitration differ greatly from domestic litigation and arbitration in the US. Depositions, wide ranging document discovery and written interrogatories will generally be excluded and arbitral hearings are often far shorter than what one finds in domestic cases. These differences can often come as a surprise to US counsel who are not experienced in the field.

In this seminar, we will review the common rules governing document production, witnesses and experts as applied in international arbitration. Attendees will also be introduced to some of the thorny evidentiary issues that often arise in this context, as well as the common solutions that are often adopted.
