A number of cases have chipped away at the clarity of statutes instructive of a trustee’s duty to account, report, and inform. The theme of these cases is that the trustee is not the settlor…therefore, who should they be accountable to? And, does it matter whether the settlor is deceased or alive? This program will look at the key statutes driving basic fiduciary disclosure obligations, illustrative cases, and ultimately examine the “empty chair” dilemma.
