The success rate for confirming a non-small business Chapter 11 plan of reorganization is said to be less than 10 percent. This program will provide valuable tips and information to help you and your client maximize those odds. The program will not specifically cover small business bankruptcies, instead highlighting some of the thornier issues arising in a “regular” Chapter 11 reorganization from start to finish (with which small business bankruptcies may have some commonality), including in-depth looks at:
● Obtaining approval to use cash collateral, including various strategies for providing adequate protection;
● Establishment of litigation trusts;
● Classifying claims and obtaining the necessary votes in favor of the plan;
● Structured dismissals as an alternative to plan confirmation; and
● Consequences—including appointment of a trustee—of mismanagement or other failures.
