A panel discussion examining the ethical duties of arbitrators to disclose potential conflicts of interest and challenges brought against arbitrators and awards for lack of arbitrator independence and impartiality in international arbitration, including recent case developments and how institutional practice and international norms align with U.S. law. This panel of leading international arbitrators, all of whom are Fellows of the College of Commercial Arbitrators, will share their insights and perspectives on these often complex and highly consequential issues. Among the topics for discussion will be what arbitrators must disclose and what they should disclose, heightened focus on disclosure for cases seated in California, and whether there are differences between international and domestic cases when it comes to arbitrator disclosures and challenges.
