    This panel will address recent and forthcoming federal and California regulatory oversight of per- and polyfluoroalkyl substances—known as PFAS or “forever chemicals.” PFAS substances have been utilized for decades in common products like cookware, food packaging, apparel and furniture. But concerns regarding potential health dangers has mobilized significant public and political scrutiny and action. This expert panel will provide an overview and discuss implications of several major developments, including USEPA’s proposed listing of certain PFAS as “hazardous substances” under CERCLA, the State’s pending efforts to establish drinking water standards for PFAS, the Attorney General’s precedential lawsuit against PFAS manufacturers, and various related considerations for environmental practitioners, including:  environmental diligence and risk assessment considerations, the potential for “reopeners” of Superfund and closed regulatory sites, and for new cost recovery or property damage litigation.
