The Saga of Donald Trump and Stormy Daniels Arbitration and Confidentiality Agreement

Donald Trump and Stormy Daniels entered into a confidentiality agreement designed to keep the story of their alleged liaison quiet. Both used aliases rather than their real names in the agreement. A corporation formed by Trump’s lawyer days before was also a party to the agreement. Trump never signed the agreement and the attorney claimed that the consideration came from his pocket. The agreement contained an arbitration clause. In order to prevent Daniels from breaching the agreement, the corporation commenced an arbitration without notice to Daniels and the arbitrator issued a temporary restraining order. We will provide an academic analysis of this arbitration and discuss whether the TRO will withstand a legal challenge.
