What You Weren’t Taught in Law School: How to Be Civil and Mind Your Ethical Obligations in What Seems Like an Uncivil World

The adversarial nature of the litigation system might seem to encourage aggression and truth-bending. This panel seeks to dispel the myth that doing so is advantageous and will give guidance on how to work with colleagues, address judges, and deal with adverse parties while maintaining professionalism and civility. The panel will also address how this interplays with attorneys’ ethical obligations regarding interactions with the court and adversaries while keeping their client's best interests in mind.

Monique Debrikka Jewett-Brewster
Attorney, Hopkins Carley, California Lawyers Association. Monique D. Jewett-Brewster is a shareholder with the law firm of Hopkins & Carley in San Jose, and co-chairs the firm’s Financial Institutions and Creditors Rights practice group and Diversity & Inclusion Committee. Monique has two decades of experience representing secured and unsecured creditors in business bankruptcy cases nationwide. She also advocates for her lender clients in the negotiation and documentation of commercial loan workouts and restructurings. A graduate of the University of Southern California School of Law, Monique served as the 2018-19 Chair of the Business Law Section of the California Lawyers Association (CLA). She is the current Co-Chair of the CLA’s Diversity Outreach Committee, which works to improve diversity in the legal profession through collaborating with diversity stakeholders in mentoring and student outreach.

Since retirement active member of the bar doing pro bono work for consumer matters and bankruptcy mediations. Member of the ILC since 2019. Also, editor of BLS submissions to the Westlaw Commercial Finance Newsletter and the ILC eBulletins.

David M. Majchrzak is a seasoned ethicist, civil litigator, and certified specialist by the State Bar of California in legal malpractice law, is rated AV®-Preeminent™ by Martindale-Hubbell, and has been recognized in Super Lawyers. He is a shareholder, who works primarily out of Klinedinst PC’s San Diego office, serves as the firm’s Deputy General Counsel, and chairs the firm’s writing committee and attorney training college. Mr. Majchrzak represents clients in matters involving attorney and law firm risk management, discipline defense, and legal malpractice claims. And he has served as an expert on legal ethics issues. He co-chairs California Lawyers Association’s inaugural Ethics Committee, is the immediate past chair of San Diego County Bar Association’s Legal Ethics Committee, and serves on the American Bar Association’s Standing Committee on Ethics and Professional Responsibility.
