Proving Likelihood of Confusion in Court and at the TTAB: Differences, Tricks and Tips
Intellectual Property Law Section; Trademark Interest Group
Section 2 (a) of the Lanham Act addresses likelihood of confusion. Although the standards for determining that are largely the same in Federal Court and at the TTAB, they take different approaches to the question. The program explores these differences and offers tips on how to address them. It is designed for practitioners who do not have a lot of experience in either forum but who should know the differences between them.
