As the practice of trust decanting becomes more widely accepted throughout the United States, and with the recent enactment of the Uniform Trust Decanting Act in California, trustees, financial advisors, and trust and estate attorneys should be cognizant of the attendant risks of litigation that may arise from using this estate planning tool. This presentation provides a general overview of decanting, and frequently litigated issues in this emerging area of law.
