Public Entity Pursuit of Environmental Justice Through Affirmative Litigation; 2023 Environmental Law Conference at Yosemite®
Public entities are taking increasing roles in pursuing environmental initiatives to protect their constituents. Their actions have ranged from enacting ordinances to pursuing affirmative litigation, including lawsuits against manufacturers for lead-based paints or against Big Oil for climate change impacts. This panel will examine how local government adopts these initiatives, the infrastructure it puts in place to pursue them, and addresses whether they are in fact filling the gaps and meeting their protective goals. The panel will also focus on public entity Affirmative Litigation Units and provide a view from the trenches of litigation.
