The Reappearing Trial: How to use technology to bring jury trials to life with in the age of COVID-19
The Online Courtroom Project (OCP) is a volunteer task force comprised of judges, attorneys, trial technicians and trial consultants whose mission is to study the challenges and possibilities of using online technology to hold jury trials, to serve as a support to courts and attorneys who are seeking ways to allow jury trials to resume in the time of COVID-19.
Our first major research project, held in June 2020, was a full online demonstration trial from voir dire to verdict, using evidence from a previously litigated slip-and-fall case. (Our report is available at onlinecourtroom.org; video of the demo trial is available on YouTube) OCP members Sarah Murray, Richard Gabriel and Ted Brooks will present video clips from that demo trial and discuss:
The status of jury trials around the country and how courts are using technology to make jury trials possible
Main questions and concerns judges and attorneys raise about conducting trials online, including:
How can we reproduce the seriousness and solemnity of the courtroom in an online setting?
How can the confrontation clause be met using remote technologies?
Can jurors, attorneys and judges judge witness credibility effectively if viewing witnesses online?
How can we know if jurors are paying attention?
How can attorneys keep jurors attentive and engaged?
How can voir dire and jury selection be done remotely?
Practical tips on using online technology from the trial trenches
