    In the first half of the presentation, Laura Chiyono Rosenthal and Hon. Therese de Silva, will examine potential racial and gender bias in apportionment.  We will discuss regulations and case law rejecting QME opinions based on risk factors related solely to the injured worker’s race or gender as well as strategies to mitigate bias in QME reporting.   In the second part of the presentation, we will discuss evaluating and rating permanent disability resulting from industrial breast cancer, taking into account the ways in which gender bias could potentially impact an assessment of the impairment that results from breast cancer and its treatment.
