Avoiding Legal Pitfalls When Handling Residential Purchases and Sales
This program will address California’s most widely used form of residential purchase and sale agreement, the California Association of Realtors “Residential Purchase Agreement” (RPA-CA), and its commonly used attachments. The program will discuss effective ways to: (i) preserve/cancel a purchase agreement; (ii) save/take the earnest money deposit; (iii) disclose “material facts”; (iv) draft unambiguous terms; (v) represent multiple parties; (vi) counsel clients about mediation and arbitration; and (vii) avoid a malpractice lawsuit.
