Public employee disciplinary hearings present increasingly complex procedural and substantive issues. Attorneys representing the employee, the employer, and the decision-maker will address advanced issues in preparing for and conducting a winning administrative appeal/arbitration hearing that will be upheld on review. Discussion will include what documents an employee is entitled to in support of their defense and how to obtain and use those documents at the hearing, contacting employee witnesses, obtaining and using investigation reports, shortening the hearing, the effect of collateral proceedings, use of after-acquired evidence, and taking a proposed decision to the final decision-maker, as well as other topics important to presenting a winning case.
