2020 Environmental Law Conference at Yosemite: Crossing the Fenceline: Emissions Monitoring at Petroleum Refineries and Beyond
In recent years, state and federal regulators and lawmakers have required air quality monitoring at petroleum refineries. In 2015, the U.S. EPA mandated continuous air monitoring for benzene, a known carcinogen, at the fenceline by January 2018 to assist in controlling hazardous air emissions. In 2017, California enacted legislation requiring that refineries install real-time fenceline air monitoring systems and that local air districts install and operate real-time community air monitoring systems near sensitive receptors by January 1, 2020. These federal and state requirements will have significant implications for refineries and adjacent communities in California, which hosts the third largest number of refineries in the nation. This panel provides an update on the status of implementation of these regulations and monitoring technologies, and explores the possible legal implications, potential for emissions reductions and safety benefits, and application of emissions monitoring at other industrial operations.
