The Rules of Professional Conduct, and the duty of loyalty, mandate that attorneys avoid conflicts of interest, at least absent informed written consent of the applicable client(s). This presentation explores the requirements for conflict waivers under the new Rules of Professional Conduct and under applicable case law, including last year's California Supreme Court decision in the Sheppard Mullin case.
