IP Issues for Commercial Property Owners: How to Avoid Paying Millions to Graffiti Artists
Artwork on buildings can be protected under a number of intellectual property regimes, including copyright or trade dress. Recently, graffiti artists have successfully sued property owners for millions of dollars the removal of graffiti in violation of a relatively new form of IP in the United States: "Artist Rights.” Most famously, a group of graffiti artists recently obtained damages of $6.7 million in a lawsuit under the Visual Artist Rights Act for the whitewashing of their graffiti by property owners at “5Pointz” in New York. The webinar will examine the various types of protection afforded artwork on buildings; the 5Pointz case and other recent cases involving artist rights; and precautions all property owners should take before allowing artwork to be created or destroyed on their buildings.
